Federal overtime baseline
Under the federal Fair Labor Standards Act, covered, nonexempt employees generally receive at least 1.5 times their regular rate for hours worked over 40 in a fixed workweek. The workweek is a recurring period of 168 hours and does not have to match the calendar week.
The regular rate may include more than the stated hourly wage. Nondiscretionary bonuses, commissions or multiple rates can change the correct overtime calculation. States and employment agreements may add daily overtime, double time or other requirements.
